Mátěráda s.r.o., Kobylská 223, 756 05 Karolinka, Czech Republic, Company ID: 03582078
(hereinafter the “accommodation provider”)
This is an English translation of the Czech original. In case of any discrepancy, the Czech version shall prevail.
1. Booking and payment
A booking is considered confirmed only after the first payment has been made in the amount set by the accommodation provider and stated in the booking confirmation or in the advance invoice. Until this payment is made properly and on time, the requested dates are held only as a non-binding option and the accommodation provider is not obliged to keep holding these dates for the guest.
The amount of the first payment depends on the date the booking is made and may be 50% or 100% of the total price of the stay. After receiving the first payment, the accommodation provider will confirm the booking, and these cancellation and payment terms apply to the confirmed booking. If only part of the price of the stay has been paid, the guest must pay the remaining amount by the due date stated in the booking confirmation or in the relevant payment document.
The day of payment is the day on which the amount is credited to the accommodation provider’s account, unless agreed otherwise with the guest.
2. Unpaid option
If the first payment is not made by the set deadline, the accommodation provider may notify the guest and, at its discretion, grant an additional period for payment. If the first payment is not made even within this additional period, the accommodation provider is entitled to cancel the option and offer the dates to another party.
An unpaid option is not considered a confirmed booking, and if it is cancelled, the cancellation terms set out in Article 3 of these terms do not apply.
3. Cancellation of a confirmed booking by the guest
The guest is entitled to cancel a confirmed booking. If the booking is cancelled before the start of the stay, the accommodation provider is entitled to the agreed cancellation fee, the amount of which depends on the time remaining until the planned day of arrival.
If the booking is cancelled before the planned day of arrival:
- 60 days or more before arrival, the cancellation fee is 0% of the total accommodation price
- less than 60 days but at least 30 days before arrival, the cancellation fee is 50% of the total accommodation price
- less than 30 days before arrival, the cancellation fee is 100% of the total accommodation price
The amount of the cancellation fee is determined by the day on which the guest’s cancellation was demonstrably delivered to the accommodation provider.
The cancellation fee is calculated from the total agreed accommodation price, regardless of what part of the price had already been paid at the time of cancellation.
If the guest has already paid more than the agreed cancellation fee, the accommodation provider will refund the difference. Conversely, if the amount paid so far is less than the agreed cancellation fee, the guest must pay the remaining amount.
The amount of the cancellation fee reflects in particular the fact that by booking specific dates the accommodation provider blocks accommodation capacity for the guest, and as the date of the stay approaches, the chance of offering these dates to another party decreases.
This provision does not affect the rights of the guest under mandatory provisions of law.
4. Unpaid balance of the price of the stay
If the balance of the price of the stay is not paid by the due date stated in the booking confirmation or in the relevant payment document, the accommodation provider may notify the guest and grant an additional period for payment.
If the balance is not paid even within the additional period, the accommodation provider is entitled to cancel the booking. In such a case, the cancellation fee is determined according to the cancellation terms set out in Article 3 of these terms, and the applicable cancellation rate is determined by the day on which the accommodation provider notified the guest of the cancellation of the booking due to non-payment of the balance.
The notice of cancellation may be delivered to the guest in particular by e-mail to the e-mail address provided when booking, or in another way that makes it possible to prove that it was sent and what it contained.
In such a case, the part of the price of the stay already paid is set off against the agreed cancellation fee. If the amount paid exceeds the cancellation fee, the accommodation provider will refund the difference to the guest. If the amount paid is less than the cancellation fee, the guest must pay the remaining amount.
5. Serious reasons and change of dates
If the guest requests cancellation of the stay or a change of dates due to a serious personal or other circumstance, the guest may ask the accommodation provider to assess the situation individually.
Depending on the circumstances, the accommodation provider may offer a change of dates, a reduction of the agreed cancellation fee, or a refund of part or all of the amount already paid. However, the guest has no automatic right to such an individual solution unless such a right arises from legal regulations or has been expressly agreed with the accommodation provider.
A change of dates is possible only with prior confirmation by the accommodation provider and depends in particular on the availability of the requested alternative dates.
6. Re-booking of the original dates
If, after the booking has been cancelled, the accommodation provider manages to book the original dates for another guest, it may, taking into account the specific circumstances, decide to refund part or all of the amount already paid, or to reduce the cancellation fee.
The fact that the original dates have been booked again does not in itself give the guest an automatic right to a refund of the cancellation fee. In its decision, the accommodation provider may take into account in particular the price at which the dates were sold again, the costs of selling them again and other circumstances of the specific booking.
7. Cancellation of the stay by the accommodation provider
If, for reasons on its side, the accommodation provider is unable to provide the guest with the agreed accommodation on the confirmed dates, it will inform the guest without undue delay.
If possible, the accommodation provider may offer the guest suitable alternative dates or another suitable solution. If the guest does not accept the alternative dates or other solution offered, the accommodation provider will refund all amounts the guest has already paid in connection with the booking that have not been used for other services agreed with the guest.
This does not affect any rights of the guest under legal regulations.
8. Final provisions
These cancellation and payment terms form part of the conditions under which the accommodation provider accepts and confirms accommodation bookings, and the guest is made aware of them before the booking is confirmed.
By submitting a booking or otherwise confirming an order, the guest confirms that they had the opportunity to read these terms. By confirming the booking and making the first payment, the guest accepts the terms applicable to that booking.
For consumers, these provisions apply only to the extent that they do not conflict with mandatory consumer protection laws. In particular, these provisions do not limit consumer rights that cannot be excluded or limited by contract.
